This Terms and Conditions of Sale (the "Contract"), published on the website https://oneeyed.com.ua, is an official offer from the ONE-EYED online store to enter into a public sales contract. This Contract governs the remote sale of products via the Internet, including the voluntary selection of products in the ONE-EYED online store, independent order placement, payment, and delivery under the terms of this Contract. The Buyer may not propose their own terms when entering into this Contract with the ONE-EYED online store.
Please read this Contract carefully. If you do not agree with any of its terms or do not fully understand any clause, we recommend that you refrain from making a purchase or reach out to us for clarification by emailing oneeyedbrand@gmail.com.
By accepting the terms of this Contract, you agree to all its provisions and confirm that you understand them in full.
This Contract constitutes a Public Offer, is legally equivalent to an "verbal agreement", holds the same legal force as a written contract, and, in accordance with the current legislation of Ukraine, is fully binding.
TERMS AND CONDITIONS OF SALE
1. DEFINITIONS
1.1. "Buyer" means the individual or organisation who buys or agrees to buy the Goods from the Seller;
1.2. "Contract" means the contract between the Seller and the Buyer for the sale and purchase of Goods incorporating these Terms and Conditions;
1.3. "Goods", "Products" means the articles that the Buyer agrees to buy from the Seller;
1.4. "Seller" means PE Moroz Yevheniia Volodymyrivna, Reg. No. (EDRPOU) 3208812707, Registered office: 18/27 Rosvyhivska St., Mukachevo, Zakarpattia region, 89607, Ukraine, that owns the ONE-EYED brand (“ONE-EYED”) and operates https://oneeyed.com.ua;
1.5. "Terms and Conditions" means the terms and conditions of sale set out in this agreement and any special terms and conditions agreed in writing by the Seller;
1.6. "Website" means https://oneeyed.com.ua.
1.7. "Order" means a properly completed and submitted request by the Buyer via the Website to purchase selected Products.
1.8. "Content" means the intellectual property of the ONE-EYED online store, including:
1.8.1. Software code, which encompasses all program scripts, algorithms, and other technical components that ensure the functionality and interaction of the Website with Buyers.
1.8.2. Design, including the design of web pages, color schemes, fonts, layouts, and other elements that define the visual appearance of the interface.
1.8.3. Product descriptions, including detailed information about each Product, such as specifications, sizes, materials, country of manufacture, and other important details.
1.8.4. Articles and blog posts, including fashion insights, style tips, trend reports, outfit recommendations, and other engaging materials.
1.8.5. Photo and video content, including images and videos of Products showcasing their appearance, features, and usage.
2. CONDITIONS
2.1. These Terms and Conditions shall apply to all contracts for the sale of Goods by the Seller to the Buyer and shall prevail over any other documentation or communication from the Buyer.
2.2. Acceptance of delivery of the Goods shall be deemed conclusive evidence of the Buyers acceptance of these Terms and Conditions.
2.3. Any variation to these Terms and Conditions (including any special terms and conditions agreed between the parties) shall be inapplicable unless agreed in writing by the Seller.
3. REGISTRATION ON THE WEBSITE
3.1. Registration on the Website is available at https://oneeyed.com.ua.
3.2. Registration on the Website is not mandatory to place an Order.
3.3. Communication between the Buyer and the Seller’s representatives must adhere to generally accepted moral principles and communication etiquette. The use of profanity, offensive language, threats, or blackmail, regardless of the form or recipient, is strictly prohibited.

4. SERVICES OF THE ONE-EYED ONLINE STORE
4.1. Product Catalog. The catalog is divided into categories based on product types, collection names, product descriptions, promotions, and/or discounts. The names of product categories, collections, and Content may be updated by the Website. In the product catalog, you can browse all collections or filter Products by various collections and categories.
4.2. Size Selection. To make selecting Products easier, the Buyer can use the size chart available on the product page. The Buyer may also contact our Support Team for guidance on taking accurate measurements.
4.3. Wishlist. The Buyer can select Products, including specific sizes, add them to a wishlist, review their wishlist, and move items from the wishlist to the Cart.
4.4. Search. To find a specific Product on the Website, the Buyer can enter the product name, category, or article number in the search bar.
4.5. Cart. To place an order, the Buyer must add the selected Product to the Cart. In the Cart, the Buyer can review the appearance, size, article number, price, and quantity of the selected Products, choose one or multiple Products for purchase, select a payment and delivery method, and apply a discount or promo code.
4.6. Placing an Order. The Buyer may order any available Product in an unlimited quantity as long as it is listed on the Website. If a Product is out of stock, the manager will notify the Buyer via email, Telegram, and/or phone call. An order is considered properly placed when the Buyer fills in all required fields that allow for identification and delivery of the Product.
4.7. Currency and Language. Buyers can adjust the Website's language settings. The content, including product descriptions and details, may vary depending on the selected language. The displayed price of the Products may also be shown in different currencies. However, please note that Buyers can only make payments in the currencies specified on the Website, and all transactions will be converted into the national currency of Ukraine (hryvnia) at the exchange rate set by the processing bank. Prices displayed in foreign currencies are for marketing purposes only, and all payments will be processed in UAH based on the exchange rate at the time of the transaction.
5. ORDERING
3.1. All orders for Goods shall be deemed to be an offer by the Buyer to purchase Goods pursuant to these Terms and Conditions and are subject to acceptance by the Seller. The Seller may choose not to accept an order for any reason.
5.2. To place an Order you must have the right to enter into agreements, meaning that you must be at least 18 years old and not be under guardianship. You must also have a valid email address and a delivery address in one of the countries that ONE-EYED provides deliveries.
5.3. The sample photos presented on the Website include one or more types of Products of a specific article and textual information about the article, available sizes, unit price, and other details.
5.4. The information provided on the Website is for informational purposes only.
5.5. To place an Order, add any available Product to the Cart using the "Add to Cart" button. In the Cart section, you can review your Order and remove unwanted Products before proceeding with the checkout.
5.6. After placing an Order, the Buyer will receive an automatic confirmation email. However, the order will only become binding after we approve it. If we confirm your order, you will receive a shipping confirmation email.
5.7. If Products are out of stock, the Buyer will be informed about the option to wait for restocking or cancel the order with a full refund within 28 days.
5.8. The Buyer may cancel the local Order for any reason up to the point of dispatch and any payments made by the Buyer shall be refunded in full within 28 days.
5.9. Seller doesn’t accept cancellation of international Orders.
5.10. If a fully or partially prepaid Order is canceled, the cost of the canceled Product will be refunded to the Buyer using the original payment method.
6. PAYMENT OPTIONS
The Buyer must pay for the Products as per the Order. Depending on the selected payment method, additional fees and charges may apply. The Buyer independently chooses one of the payment methods listed below.
6.1. The Buyer can pay for the Order using Visa, MasterCard, Apple Pay, or Google Pay through secure payment system "Plata by mono".
6.2. If payments are made using "Plata by mono", the Buyer completes the payment on the payment system's secured page. The Buyer pays only for the Product; no additional online payment fees apply.
6.3. The Buyer can also pay by bank transfer to the Seller’s account using the provided payment details. After making the payment, the Buyer will receive confirmation via email, Telegram, or Instagram.
6.4. Payment receipts and invoices will be sent to the Buyer’s email after the payment is completed.
6.5. ONE-EYED reserves the right to verify the validity of the credit or debit card, its credit status in relation to the order amount, and the Buyer’s address details. Based on these checks, the Seller may refuse the Order.
6.6. Please note that the Seller does not accept gift cards or store credit cards as payment on the Website.
7. PRODUCT PRICING
7.1. The price of the Goods corresponds to the price displayed on the Website and does NOT include shipping costs. While we strive to ensure that all prices on the Website are accurate, errors may occur. If the Seller detects an error in the price of any Product ordered by the Buyer, we will immediately inform them and offer the choice to confirm the Order with the correct price or cancel it.
7.2. Goods prices on the Website may change at any time. However, except for cases mentioned above, any price changes do not affect Orders that have already been confirmed.
7.3. The total cost of the Order will be displayed in the Buyer’s Cart before confirmation.
7.4. Once the Order is received, the Seller will send an email confirming the details, description, and price of the Product.
7.5. Please note that prices on the Website do not include international taxes, customs duties, or VAT. If the Buyer’s Order exceeds the duty-free limit in their country, additional import taxes/customs duties may apply upon delivery. ONE-EYED does not reimburse these costs. For further information, please contact your local customs office.
7.6. The Seller may occasionally offer promotions, promo codes, gifts, and other special deals. Such offers are valid only for the specified period and under the conditions directly associated with them. Offers cannot be combined with other discounts unless explicitly stated otherwise.
8. DELIVERY
The Buyer can choose a preferred shipping method at checkout. The available shipping methods and carriers are subject to change. Details on shipping options and conditions are available on the Payments & Delivery page of the Website.
8.1. The Buyer can pick up their Order in person from the Seller’s workshop at the following address: 79019, Lviv region, Lviv, 31, Sofia Yablonskaya St. (Zavodskaya St.). Self-pickup is available by appointment only. The Buyer must contact the Seller in advance using the provided contact details to arrange a pickup.
8.2. Domestic deliveries within Ukraine are carried out by Nova Poshta. The Seller is not responsible for the final shipping cost, as delivery rates are determined by the carrier.
8.3. Orders are delivered to the address specified by the Buyer during checkout.
8.4. Orders are usually dispatched after 6:00 PM, with delivery times ranging from 1 to 7 business days, depending on stock availability. In some cases, delays may occur due to public holidays or stock shortages. If a Product is out of stock, the Seller will notify the Buyer and arrange a new delivery timeframe, an exchange for another Product, or a refund.
8.5. The Website offers international shipping via Ukrposhta and Nova Post. International delivery times vary based on the destination country, border conditions, customs procedures, and regulations. Typically, international shipping takes 10 to 28 business days. The Buyer is responsible for all customs clearance procedures and duty payments.
8.6. Please, note! Prices on the Website do not include import taxes, customs duties, or VAT. If the Buyer’s international Order exceeds the duty-free limit in their country, additional import taxes/customs duties may apply upon delivery. ONE-EYED does not reimburse these costs. For further details, please contact your local customs office.
8.7. After the Order is shipped, the Seller will send a tracking number to the email address provided by the Buyer at checkout. Delivery is considered complete once the Buyer receives the Product at the specified address or designated pickup point.
8.8. Upon receiving the Product, the Buyer must inspect it for quantity, quality, assortment, and completeness.
8.9. Risk in the Goods shall pass to the Buyer upon delivery of the Goods.
9. EXCHANGE AND RETURNS
9.1. If the Buyer wishes to return or exchange all or part of a purchase for any reason, they have the right to do so within 14 (fourteen) calendar days from the date of receiving the Product, in accordance with the current Law of Ukraine "On Consumer Protection". A return or exchange is allowed if the Product does not meet the Buyer’s expectations in terms of shape, dimensions, style, color, size, or for any other reason preventing its intended use, as specified in Article 9 of the Law of Ukraine "On Consumer Protection".
9.2. Returns and exchanges are processed according to the Return Policy outlined on the Website in the Returns & Exchanges section.
9.3. A Product of proper quality or one that does not meet the Buyer’s expectations may be exchanged or returned under the following conditions: the Product has not been used and shows no signs of wear; the Product retains its original consumer properties and appearance; all labels and tags are intact, and the original packaging is undamaged; the Buyer provides proof of purchase (receipt or invoice); the Buyer includes a completed return form.
9.4. The cost of shipping for returns or exchanges of properly delivered Products is paid by the Buyer.
9.5. If the Buyer receives a Product that does not match the order in terms of color, size, or model, or if the Product is defective due to a manufacturing flaw or has significant issues that make it unusable, the Buyer has the right to exchange or return the Product within the legally established period. In this case, the Seller covers the return shipping costs.
9.6. Where returned Goods are found to be damaged due to the Buyers fault the Buyer will be liable for the cost of remedying such damage.
9.7. If the Buyer knowingly orders discounted or defective Products of improper quality, these items are not eligible for return or exchange. By purchasing such Products, the Buyer agrees to these terms and waives any claims regarding return or exchange refusals.
9.8. Ukrainian law defines a list of Products that cannot be returned. Buyers are not allowed to return items that have been used, made to order, customized for a specific Buyer, or items that are non-returnable for hygiene reasons, such as: underwear, bodysuits, pajamas, corsets, swimwear, opened and tried-on tights or socks.
9.9. If the Buyer cancels a purchase, the Seller will refund the cost of the returned Product within 14 days from the date the returned Product is received at the Seller’s warehouse. The refund amount will exclude the Seller's expenses related to the return shipping costs.
10. FAULTY ITEMS
10.1. The Buyer shall inspect the Goods immediately upon receipt and shall notify the Seller by email or writing within 7 days if the Goods are damaged or do not comply with any of the Contract. If the Buyer fails to do so the Buyer shall be deemed to have accepted the Goods.
10.2. Where a claim of defect or damage is made, or the wrong goods have been sent, the Goods shall be returned by the Buyer to the Seller within 14 days of delivery. The Buyer shall be entitled to a replacement or a full refund (including delivery costs) plus any return postal charges if the Goods are in fact defective.
10.3. Goods must be returned by the Buyer within 14 days of cancellation in the original packaging and should be adequately insured during the return journey. The Buyer will receive a refund of all monies paid for the Goods (including delivery charges, if any, and return postal charges). If the Buyer fails to return the Goods following cancellation, the Seller shall be entitled to deduct the cost of recovering the Goods from the Buyer.
11. BUYER RIGHTS AND OBLIGATIONS
11.1. The Buyer has the right to: place orders with or without account registration; register on the Website and gain access to a Personal Account and additional services; order and receive Products; cancel a purchase and return Products; unsubscribe from Website newsletters; use bonuses and discounts; review the Website’s Privacy Policy and limit the processing of their Personal Data as outlined in the Terms; select a preferred delivery method.
11.2. The Buyer is obligated to: comply with the Terms and Conditions of this Agreement; pay for and accept the ordered Product as per the conditions specified in the Contract; read the Product instructions before use and follow the care and maintenance guidelines; use the Website’s content only as permitted; keep their Personal Account login credentials secure and prevent unauthorized access by third parties.
12. RIGHTS OF SELLER
12.1. The Seller reserves the right to periodically update prices on the Website, which cannot be guaranteed for any period of time.
12.2. The Seller reserves the right to withdraw any Goods from the Website at any time.
12.3. The Seller shall not be liable to anyone for withdrawing any Goods from the Website or for refusing to process an order.
13. LIMITATION OF LIABILITY
In the event of any breach of these Terms and Conditions by the Seller the remedies of the Buyer shall be limited to damages which shall in no circumstances exceed the price of the Goods and the Seller shall under no circumstances be liable for any indirect, incidental or consequential loss or damage whatever, except as may be implied by Ukrainian law.
14. WAIVER
No waiver by the Seller (whether express or implied) in enforcing any of its rights under this contract shall prejudice its rights to do so in the future.
15. FORCE MAJEURE
The Seller shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to, acts of God, strikes, lock outs, accidents, war, fire, failure of any communications, telecommunications or computer system, breakdown of plant or machinery or shortage or unavailability of raw materials from a natural source of supply, and the Seller shall be entitled to a reasonable extension of its obligations.
16. SEVERANCE
If any term or provision of these Terms and Conditions is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if these Terms and Conditions had been agreed with the invalid illegal or unenforceable provision eliminated.
17. CHANGES TO TERMS AND CONDITIONS
The Seller shall be entitled to alter these Terms and Conditions at any time but this right shall not affect the existing Terms and Conditions accepted by the Buyer upon making a purchase.
18. GOVERNING LAW AND JURISDICTION
These Terms and Conditions shall be governed by and construed in accordance with the law of Ukraine and the parties hereby submit to the exclusive jurisdiction of the Ukrainian courts.
19. INTELLECTUAL PROPERTY
19.1. The Seller owns all intellectual property rights, including copyrights, trademarks, and other proprietary rights related to the Content published on the Website and the Seller’s social media platforms. Unless explicitly stated otherwise, the Buyer must assume that all Content and ownership rights are protected by intellectual property laws and cannot be used in any manner other than as permitted by this Contract.
19.2. The Buyer has no rights to any Content belonging to the Seller and agrees not to copy, republish, modify, distribute, license, or create derivative works based on the Seller’s Content or services, except as expressly allowed by this Contract.
19.3. Any unauthorized use of the Seller’s intellectual property is strictly prohibited. The Seller will enforce its intellectual property rights in accordance with Ukrainian law. The Buyer’s use of any part of the Seller’s Content is subject to the terms of this Contract.
20. OTHER TERMS
20.1. The relationship between the Buyer and the Seller is governed by the applicable laws of Ukraine.
20.2. Product images displayed on the Website may differ from the actual appearance of the Products. The descriptions and specifications provided are not exhaustive and may contain typographical errors.
20.3. The Seller is not responsible for: minor discrepancies in color representation due to variations in screen displays of different devices; the accuracy or truthfulness of the information provided by the Buyer when placing an order; delays or interruptions in order processing and delivery caused by factors beyond the Seller’s control; illegal actions carried out by the Buyer using their access to the internet; the disclosure of the Buyer’s network identifiers (IP address, MAC address, login, and password) to third parties.
20.4. The Seller reserves the right to expand or reduce the range of Products available on the Website.
20.5. The Website and its services may be temporarily unavailable due to maintenance, updates, or other technical reasons. The Seller’s technical team reserves the right to conduct scheduled or unscheduled maintenance with or without prior notice to Buyers.
20.6. The section headings in this Contract are provided for convenience only and shall not be considered as having any legal significance when interpreting any provisions of this Contract.
